TRADE LICENSE

Trade license is one of the licenses that is issued by municipal Corporation which gives Permission to carry out a particular business in a particular address, it is one of the initiatives to regulate trade and to ensure that the citizen hour not adversely affected with any nuisance or health hazards surely it ensures that the particular trade is carried out accordingly to the relevant rules and regulation and safety, standard guidelines or not.

SHOP AND ESTABLISHMENT LICENSE

It is a mandatory license for all business entities. It includes Shop and the commercial establishment and also works from home jobs. After Registration, we will get a shop and establishment certificate. Every Shop or establishment must apply the registration process within 30 days of commencing operation. This is to be submitted to the local municipal Corporation of the respective state for getting the license, this Act was mainly in acted to regulate the condition of workers and employees working in a shop or commercial establishment.

 “Shop “means any premises where any company or operation is carried on or where facilities are offered to customers, , godowns or warehouses, including offices, stores whether at the same premises or otherwise, used in connection with such company or trade.

Commercial establishment” means a shop, commercial establishment, residential hotel, restaurant, or other public leisure or café, eating house, theatre, entertainment facilities to which this Act refers.

  • To ensure for the better the standards of employment
  • To ensure the right of workers protection
  • To ensure that the worker adequately compensated or treated well in the establishment
  • To ensure that business complies with the requirement process

DIFFERENCE BETWEEN TRADE AND SHOP ESTABLISHMENT LICENSE

  1. A trade license is a Permission given to carry out a particular business, while a Shop establishment license is given to an individual who is going to commence any business or Shop Registered with the local government in the shop establishment act.
  2. Trade license can only be obtained on commercial premises, but Shop and establishment can be obtained on residential premises.
  3. Trade license are mainly required for the establishment like canteen, restaurant, manufacturing industries, cyber Cafe, etc. While Shops establishment licenses are required for a commercial establishment or every Shop that is doing business or providing any type of services.
  4. Both the license i.e. trade and stop establishment license laws, vary from state to state.
  5. The Shops and Establishment Act governs the Rights of workers engaged in the organized sector. It also includes leave, holidays, etc.

The following document is required for the process of application prescribed by the state government is 

  • PAN of the proprietor
  • Address proof the proprietor
  • Proof of establishment, i.e., electricity bill, etc
  • Details of the establishment i.e., Number of employees
  • AOA and MOA of the company 
  • Certificate of incorporation
  • IT returns 
  • Affidavit
  • NOC from landowning agency

PROCEDURE FOR REGISTRATION OF SHOPS AND ESTABLISHMENT IN DELHI

The applicant must fill in the name of employer, address, name, category of the establishment, number of employers on the registration form after the verification from the chief inspector you are sure will be registered. There are the following process in which the procedure is given – 

  • The applicant had to fill the form A, which is available online in the government website, labour department, and it should be in reference to Delhi shops and establishment rules, 1954
  • The second step is that the applicant had to send a statement to the chief inspector in Delhi with form within 90 days and with the prescribed Fee.
  • The third step is that after receiving the statement of prescribed Fee, the chief inspector will carry out verification and inspection about the statement you have made, and after that, he will issue the registration certificate to the owner of the Shop or commercial establishment in Delhi.

THE REGISTRATION PROCESS FOR THE SHOP AND ESTABLISHMENT ACT IN UP

There is an online process for Registration, the applicant have to visit the website uplabour.gov.in. After that applicant have to registered by filling in the details in the application form

  • After filling the form, it will generate a user ID and password
  • Now after agree the applicant, Press the button, calculate Fee and save the form
  • Applicants have to upload necessary documents such as identity proof, PAN card, etc
  • The applicant had to pay the prescribed fee
  • After making payment, applicants have to fill the challan number, bank name, date in the form and submit
  • After inspection, the labour enforcement officer can accept/reject the application
  • After being approved applicant have to go to view the application and download the certificate form of Shop and establishment

REGISTRATION PROCESS FOR SHOP AND ESTABLISHMENT IN HARYANA

  • There is the online process for Registration in Haryana, applicant had to registered an account on in West Haryana website which he had to submit his name username, mail ID, phone number, etc
  • The second step is that the applicant had to add CAF and click on shop registration
  • The applicant had to fill the application form for Registration
  • Applicant have to fill the form F in which it contains details like the number of employees proof of Shop any electricity bill, phone bill and it contains two photos from outside including surrounding and to photo inside the Shop and contain two photos of the office
  • The applicant had to fill the form B in which it contain employees name and the timing of office or Shop
  • After filling the form, the applicant had to pay the application fee
  • It may take 1 to 2 weeks to review and approve the registration certificate.

SOME KEY PROVISION OF THE FOLLOWING STATES

  • It is mandatory for the honour of establishment to submit the information related to employers to the labour department.
  • Factories are not allowed to take this form of the Registration; this is only for the shops and other forms.

  • Information of the loan
  • Information of penalty if imposed for non-compliance
  • After taking the Registration and license the following points have to be consider
  • The registration license has to be renewed annually
  • The inspector can conduct a periodic inspection after the certificate is provided
  • If there is any closer to the establishment, it must be notified to the local inspectors within 15 days in advance
  • The shop or establishment certificate must display in the area which is visible to the public
